we could be talking about some low level snowfall this morning although that has not occurred just yet. otherwise, just count on giving yourself extra time. grab your jacket. we'll only break into upper 40s today. we've got a lot to talk about when it comes to timing of this system. stick around. 4:31. if you can. if not, mike is here to help you get out the front door. >> looking toward southbound 880 through fremont. the reason i point this out, i drove through this stretch past tesla and had to use my wipers. misty conditions out there. map shows you no problems as far as drive. speeds going through this area watching as that mist and drizzle coming into the area and rain for morning commute later. no problems out of the tri-valley. back to you. >> thank you very much. we are following breaking news in south africa this morning where we learn olympian oscar pistorius has been charged with premeditated murder. he arrived at a south african

courtroom this morning but prosecutors accused him of shooting his girlfriend, reeva steenkamp, three times through the bathroom door. the two got into an argument on valentine's day. that's when she ran to the bathroom and locked herself in. they allege pistorius fired through the door. prosecutors say he broke down the door and was found by police performing cpr on her in the hallway. the defense says there was no murder involved and steenkamp's death was an accident. in the meantime, a memorial was held this morning in her hometown about 600 miles from where the court appearance was taking place. closer to home, police have released a sketch of a man they say attacked and raped a young woman visiting the uc santa cruz campus. look at this here. the victim describes him as a muscular white man in his 30s with dark hair, a full mustache and goatee and a tattoo on his

upper right arm and smelled of cigarettes. the victim was treated at a hospital for bruises. how did he fall? that's questions rangers are trying to answer after a hiker died after falling 150 feet down a cliff. the middle-aged man went hiking saturday. rangers say he ventured into a dangerous area that was closed to the public and clearly marked for park visitors to stay out. they say deadly accidents are rare and preventible if visitors obey the signs. police are calling this an accident. the city of hayward sweeping down on internet cafes. they are a form of illegal gambling. the city council will consider an emergency ordinance tonight that would shut down any cafes for a total of 45 days and once the moratorium is in place, the

council will discuss a long-term solution. folks are trying to fight to keep a beloved theater company open despite fund-raising and ticket sales, the rep has to do more to keep the doors open. its fight to survive has been going on for years. back in 2006, the theater almost shut down before the city stepped in and bailed it out to the tune of $2 million. an amount the rep will have to pay back over the next 25 years. the theater says shutting down would leave a big hole in the arts community. >> the arts are very often really sort of the reflection of a soul of the city. i think that it's important to have groups like san jose rep. >> the rep says it has an action plan to get auditors off its back building up a cash reserve of $200,000 every year. the director says they'll have $50,000 in the reserve by the end of the year thanks to foundations and other generous donors. mayor ed lee expected to make a big-time announcement surrounding that new development

project near at&t park. the san francisco chronicle reporting the mission rock development project has landed its very first tenant. that being anchor brewing company will occupy what is now pier 48. the mission rock development is being built just south of at&t park. it includes plans for 1,500 apartments along with retail and office space. construction could start as early as next year. talking about a storm hitting the bay area. already running windshield wipers out the door. expect that. let's check in with meteorologist christina loren. what else can we expect? >> not just the rain, jon and laura. we're looking for formation of strong thunderstorms. that's possible as we head throughout the afternoon. and this morning we don't have a lot of shower activity to show you but it is getting more active in the north bay. those showers will move south. chilly out there. look at the snow coming down in

tahoe this morning. great looking day shaping up there for skiers and snowboarders. we'll probably get back up to 100% of normal when it comes to snow pack after this storm system comes through here in tahoe. for today what you need to know, bring that umbrella. make sure you have heavy coat. highs are only going to end up in upper 40s and low 50s. as of tomorrow we're going to stay just about as cool. this is not our only chance for rain this week. we'll take you through your seven-day forecast and show you when to break out that umbrella yet again. count on a rough drive to work. let's check on that with mike. >> look at the san mateo bridge. our camera here on the toll plaza side on hayward, not enough to be an issue as far as raindrops but it's enough to be annoying on a lens here just a couple misty drops stuck there illustrating what's going on around the bay. misty conditions affecting your drive and you'll need wipers in the south bay as well. we're looking toward 880 and 92 interchange. no problems there. coming off the castro valley y

countercommute east 580 there is a crash there and it does look like there's slowing at the transition right now. we'll let you know as lane information comes in from chp. they just got the call. we'll track it. the rest of the area looking smooth down into the south bay like we talked about. 101, 87, 85, you may get mist there. orange on sensors here on my map shows you where you may get issue as far as needing to use the windshield wipers into san jose. funeral services will be held next tuesday for lou spadia. once part owner of the 49ers and started working with the team when they were founded back in 1946. worked his way up from equipment manager and to president and eventually owner. he died on sunday at the age of 92. the issue is settled after berkeley's men's basketball coach was caught on camera shoving one of his players. this morning not everybody is satisfied with that decision. state senator leland yee wants

coach mike montgomery suspended for the incident. you can see montgomery shoving alan crab during sunday night's game. crab upset there and wanted to go after the coach. montgomery eventually issued an apology yesterday saying his behavior was inappropriate. the pac 12 says it reprimanded montgomery. state senator yee says he wants montgomery suspended for one game. state's men's basketball coach says he's not been fired. he confirmed with the bay area news group -- this happened late last night. he says he's still the spartans head coach. an internet report said they were dismissed effective immediately. the spartans not a very good season. lost ten consecutive games and won only four conference games over the past two years. speaking of losing streaks, warriors return from the all-star break trying to snap

week. the nasdaq broke a win streak but the s&p extended winning ways to seven weeks. the last time the s&p 500 started out the year with such a streak was 1967. that's a stat for you. we get data on housing and dell and marriott. watch out for that. in terms of how we ended on friday because of the three-day weekend, the dow rising eight points and nasdaq slipping just six to close at 3192. and here's our top story. another big name merger in the works. cnbc learned office max and office depot have been in advanced talks since late last year and a deal could be announced later this week. the office supply combo is aimed at taking on larger rival staples. analysts called for consolidation in the market which saw sales crumble during the financial crisis. office supply chains are struggling to stay relevant as consumers are increasingly buying their paper, toner and

other items online or big box stores like walmart. back to you. >> thanks for the update. since it is 4:45 right now. i'll try to jump ahead of the curve and call this precipitation tuesday. christina loren is here to explain what's coming our way. >> finally a change is coming our way. it's not a very welcome change by some standards out there. 4:45. a cold day. temperatures in the 40s. and we've got rain as well. only one day of heavy rain. the next couple chances we get as we head further into the week not looking as impressive. today we talk about 90% to 100% chance of rain. it's going to rain. throughout the latter portion of the week, 30% chance on thursday and so today is our weather today. 50 degrees in oakland to start. 45 in livermore. you are at 42 degrees in gilroy. starting to get more action now. showers pushing from sonoma to marin county. slick along 101.

showers headed toward the golden gate bridge. watch out for slick conditions there throughout the next 15 to 20 minutes. as i widen out, you can see not getting a lot of activity just yet. this is going to continue the front pushing south as we head throughout the morning hours. let's time it out on future cast. we stop the clock at 7:00 a.m. that's when the front starts to arrive. the main event in the north bay. by 9:00 a.m., moderate showers and light activity along the peninsula. from the north bay to palo alto, slick conditions at 9:00 a.m. count on a rough drive to work this morning. by 11:00 a.m. during the mid-day broadcast, a lot of rain headed toward the south bay. potentially up to three-quarters of an inch. once the sun comes back out tomorrow, it's going to be a winter wonderland on top of mt. hamilton. we can't wait to see that. maybe picking up three inches of the white stuff above 4,000 feet in the bay area. by 3:00 a.m. wednesday, our skies clear. temperatures drop off. we could be talking about

records tomorrow morning. keep that in mind. although your highs are going to creep up from today's. 48 degrees is cold in livermore. 49 in fremont. 50 degrees today in san francisco. getting into your thursday, there's that 30% chance of rain. isolated shower and 20% shot on saturday. sunday into monday we dry out and warm up. another steretch of warm weathe on the way. new details on what may have motivated adam lanza to shoot 26 people at sandy hook elementary school. lanza saw himself as being in competition with anders breivik. he carried out a bomb attack and shooting rampage in norway that killed a total of 77 people back in 2011, most of them schoolchildren. cbs news reporting lanza's goal was to kill more people than

breivik did and he saw the school in newtown, connecticut, as an easy target. a connecticut state police spokesperson is disputing those claims calling them "mere speculation." he says investigators at this point are a long way away from determining an exact motive. >> either way, still so tragic. today vice president joe biden will address gun violence during a facebook town hall meeting. the vice president will respond to questions submitted by readers of "parents" magazine. the event will be streamed live on facebook page and also on the white house's website. president obama and congressional staffers back to work on capitol hill this morning but the lawmakers themselves are away on recess. time running out for congress to avoid that self-imposed 85 billion in spending cuts set to kick in at the start of march. lawmakers are not entirely on vacation. they are back in their districts talking about the possible impact of these cuts. some voters are criticizing congress to going on recess at a

crucial time. insiders say staffers are continuing negotiations even with their bosses away. >> i believe at the staff level but also at the member level behind the scenes there is a lot of maneuvering back and forth. >> if those cuts do kick in, we all could feel the impact fairly quickly. for example, meat inspector furloughs could slow down production driving up the cost of your main course and your protein. and in san diego, about 30,000 military jobs would be in jeopardy. notre dame football player duped by an online hoax getting ready for the nfl draft. manti te'o will be at the combine. he made headlines after having a relationship with a fake online girlfriend. he says he does not think the scandal will prevent him from being picked in the first round and doesn't understand how it would take away from what we did on the field.

welcome back, everybody. a live look over a dark san francisco right there. at least conserving energy going green this morning out there. christina loren says expect showers heading our way so you might want to think about an umbrella heading out the door. it's 4:54. this one has got to be the biggest stair style since the rachel. first lady michelle obama talking about what's behind that new look all those luscious bangs. during a recent interview, mrs. obama joked that her new haircut is the result of a mid life crisis. the hairstyle was revealed on her 49th birthday a few days before the president's second inauguration. it was a big hit worldwide. she says she cut her bangs

because secret service won't allow her to get a sports cars and she also is not allowed to bungee jump. >> she got crazy with the hair. >> i think she looks good. >> she always consistently does. she can pull it off. let's check if that would work today. i don't know with all of the rain out there. what about the slick roadways. >> i keep bangs out of my way. >> you do a good job. >> thank you very much. >> you should let them down one day. >> that would be jarring for people around the bay area. looking toward the bay bridge. nothing jarring but a slight adjustment as that rain comes through. you'll have to watch those conditions and lower speeds accordingly. right now a smooth drive and some mist and that's what's impairing our view of city lights from east bay, emeryville camera here. a look at the map. maze shows a smooth flow of traffic. nothing unexpected through the area except that road crews were not in place overnight. crash still going on here.

this is east 580 off the merge with 238. it looks like it is sticking out into one of the lanes and flashing lights as chp arrives causing distraction. we'll track that minor injuries at most. it sounds like nothing serious. we'll track that again through the castro valley y approaching the san mateo bridge. no big deal. back to you. >> speaking of cars, bmw recalling thousands of cars for a faulty battery connector. it can fail and cause the engine to stall. the recall affects the popular 3 series sedans, wagons, convertibles and coupes. also included are one series coupes and convertibles from 2008 to 2012. bmw says it knows of one minor crash in canada due to the problem but no injuries. it will start notifying owners of that recall next month. new this morning, a sudden fire at a florida gas station

all caught on tape. this one is kind of wild. a driver passing by that gas station in jacksonville jumped up and grabbed his cell phone and caught this video last night. two pumps there on fire. there were also some vehicles nearby. here's the good news. nobody was hurt. no serious damage here. the fire marshal now working hard to figure out exactly how this one happened. the driver said i'm getting out of here. >> got to be careful. 4:57. coming up, our storm watch continues. meteorologist christina loren will have the very latest on when that rain is going to hit the greater bay area and where it is hitting right now. >> we'll take you down to scottsdale. no rain down there today. we'll let you know what giants are doing to fine tune before the ason starts and get you stuff from the broadcast booth.

right now the once revered olympian oscar pistorius is facing a magistrate for the second time. he's being accused of shooting his model girlfriend to death and by all accounts he's having extremely hard time just keeping it together in court. often breaking down uncontrollably there on scene. "today in the bay's" marla tellez has been monitoring this all morning long. new developments here in our newsroom this morning. this hearing right now is happening while his girlfriend is simultaneously being laid to rest. >> to say it's an emotional day for the pistorius family and the family of reeva steenkamp is a major understatement. we'll begin in the courtroom where oscar pistorius is so distraught he's spending most of the time sobbing. the prosecution is arguing he shot and killed his 29-year-old girlfriend in an act of premeditated murder saying pistorius fired through a bathroom door where steenkamp locked herself in after an
